What is a Power of Attorney?

A PoA is a legal document by which a principal (donor) appoints an agent (attorney‑in‑fact) to perform specific or broad tasks—managing property, finances, business affairs, or healthcare—when the principal is unavailable or incapacitated.

Types of Power of Attorney

Conventional (General/Limited), Durable (survives incapacity), Springing (effective upon a trigger event), and Medical PoA (healthcare decisions).

Who Can Be an Agent?

Any trustworthy adult (≥18 years) of sound mind. Multiple agents may be appointed with joint or independent authority to ensure continuity.

Revocation and Duration

The principal may revoke at any time by written notice if mentally competent. A PoA can specify an expiry date or remain effective until revoked.

Key Advantages

● Ensures uninterrupted management of affairs ● Customizable scope—from narrow tasks to broad durable authority ● Allows remote or incapacitated principals to delegate power ● Provides clear legal protection and avoids future disputes

Dos and Don’ts for Agents

Allowed: manage property, pay bills, operate accounts, make healthcare decisions. Not allowed: mix finances, act in self‑interest, restrict principal’s freedom, make decisions when principal is competent.

1. Documents Required

● Principal’s and agent’s photo ID & address proofs

● Two witnesses’ IDs and signatures

● Draft PoA on state‑appropriate stamp paper

● Notarization certificate

● Embassy/consulate attestation for NRIs

Execution and Registration

● Draft PoA clearly naming parties, scope, duration, revocation clause

● Notarize document per state rules

● For immovable property powers: register at sub‑registrar within 4 months with parties and two witnesses (or POA)

● Pay state‑specific stamp duty (higher if non‑relative or property transaction)

Stamp Duty and Fees

Stamp duty depends on state law, relation of agent, and transaction value or compensation amount. DoStartup assists with accurate calculations and payments.

Validity and Timing

PoA takes effect on signing or upon a specified condition; register immovable property PoAs within four months, else they are unenforceable in court.
