What is a Power of Attorney?
A PoA is a legal document by which a principal (donor) appoints an agent (attorney‑in‑fact) to perform specific or broad tasks—managing property, finances, business affairs, or healthcare—when the principal is unavailable or incapacitated.
Types of Power of Attorney
Conventional (General/Limited), Durable (survives incapacity), Springing (effective upon a trigger event), and Medical PoA (healthcare decisions).
Who Can Be an Agent?
Any trustworthy adult (≥18 years) of sound mind. Multiple agents may be appointed with joint or independent authority to ensure continuity.
Revocation and Duration
The principal may revoke at any time by written notice if mentally competent. A PoA can specify an expiry date or remain effective until revoked.

● Principal’s and agent’s photo ID & address proofs
● Two witnesses’ IDs and signatures

● Notarization certificate
● Embassy/consulate attestation for NRIs
Execution and Registration
● Draft PoA clearly naming parties, scope, duration, revocation clause
● Notarize document per state rules
● For immovable property powers: register at sub‑registrar within 4 months with parties and two witnesses (or POA)
● Pay state‑specific stamp duty (higher if non‑relative or property transaction)
