What Is a Relinquishment Deed?

When someone dies intestate (without a will), their property is inherited by legal heirs. A Relinquishment Deed lets one heir release their share in favor of other co‑heirs, with or without payment, under Section 17 of the Registration Act, 1908.

Includes title, date, executant (releasor) details, releasee details, full property description (survey/registration numbers), purpose of relinquishment, heirs’ shares, declaration of voluntary release, and signatures with two witnesses.

Irrevocability & Legal Effect

Once executed and registered, the deed is final and the releasor loses all rights and liabilities; the releasee gains full title. It can only be challenged on grounds of fraud, coercion, lack of consent, or mutual cancellation within three years.
