According to Section 25 of the Water (Prevention and Control of Pollution) Act, 1974, setting up any outlet requires compliance with environmental provisions. Similarly, operating an industrial plant requires adherence to Section 21 of the Air (Prevention and Control of Pollution) Act, 1981.

Types of NOC under SPCB

The clearance board mandates two main types of No Objection Certificates (NOC): Consent to Establish (CTE) and Consent to Operate (CTO).

Consent to Establish (CTE)

The Consent to Establish is essential for starting or setting up any manufacturing or processing industry. This consent acts as the initial clearance for industries that may cause air, water, or noise pollution.

Consent to Operate (CTO)

The Consent to Operate ensures that industries adhere to environmental regulations during operations. All operating units must obtain this consent from the respective SPCB to legally run their operations.

- Layout plan of the facility, showing sewage and effluent treatment structures and emission points.

- Details of the DG set with specifications and capacity.

Steps to Obtain NOC from SPCB

1. Submit Required Documents

○ Submit necessary documents, forms, and prescribed fees online through the Consent Management and Monitoring System.

2. Trial Production Consent

○ Consent to Operate (CTO) is mandatory even for trial production under environmental laws.

3. Inspection by Authorized Officer

○ An authorized officer carries out an inspection before the NOC is granted.

4. Verification of Pollution Control Measures

○ For first CTO under the Water Act, 1974 or Air Act, 1981, and Hazardous Waste Authorization, the competent authority will verify the pollution control measures established during Consent to Establish (CTE).

5. Second Inspection

○ After approval, a second inspection is conducted within 3 months to ensure compliance with environmental norms.

6. Validity of License

○ If the unit meets the standards, the license remains valid.

7. Non-Compliance

○ Non-compliance will result in revocation of the license.
